The domain of the contracts of which the subject matter is right to use immovable property is vaste and diverse, since it includes in particular timeshare contracts as well as leases, for example, rental contracts for residence, commercial leases or seasonal leases. In european private international law, the determination of the jurisdiction and the applicable law as regards contracts of which the subject matter is a right to use immovable property can sometimes pose delicate problems. This study highlights these difficulties whilst trying to propose some improvements to the currents texts. This analysis also aims to show what is nowadays the influence of the place of immovable property's situation on the determination of the jurisdiction and the applicable law to such contracts.

Le domaine des contrats ayant pour objet un droit d'utilisation d'un immeuble est vaste et varié, puisqu'il comprend notamment les contrats de timeshare et les contrats de baux d'immeubles, tels que, par exemple, les baux d'habitations, les baux commerciaux, et les locations de vacances. En droit international privé communautaire, la détermination de la compétence judiciaire et de la loi applicable pour ces contrats peut parfois poser de délicats problèmes. Cette étude met en évidence ces difficultés tout en tentant d'apporter certaines améliorations aux textes actuels. Cette analyse a également pour objectif de montrer quelle est, de nos jours, la force d'attraction du statut réel lors de la détermination de la compétence judiciaire et de la loi applicable en matière de contrats ayant pour objet un droit d'utilisation d'un immeuble.
