L'impartialité à la lumière de la convention européenne des droits de l'homme

The European Court has widely interpreted the area of enforcement of the 6. 1 article of the Convention, enabling the judge to free himself from the qualification of the court to enforce the guarantee of impartiality. Besides, the Court has provided analysis methods to check if the procedures called into question can meet the requirement needed by standart of impartiality of the 6. 1 article. The french judges take over the 6. 1 article and the interpretation power that the article imparts to them. They have allowed themselves to control the rules and the internal practices in the light of standart of impartiality and have, when necessary, interpreted the texts, freeing themselves from their letter. The examination is generalized to all the procedures, particularly in public law. This control also enables to raise the level and the consistency of the rules, securing the impartiality before the ordinary courts of laws and sometimes leading to the alteration of text.

La cour européenne a interprété largement le champ d'application de l'article 6. 1 de la Convention, permettant au juge de s'affranchir de la qualification de tribunal pour appliquer la garantie d'impartialité. La cour a en outre donné des méthodes d'analyse por vérifier si les procédures mises en cause permettent de satisfaire à l'exigence par le standart d'impartialité de l'article 6. 1. La cour invite à plus de souplesse dans la lecture des règles. Les juges français s'approprient l'article 6. 1 et le pouvoir d'interprétation qui leur confère. Il se sont autorisés à contrôler les règles et pratiques internes à l'aune du standart d'impartialité et ont au besoin interprété les textes en s'affranchissant de leur lettre. Cet examen est généralisé à toutes les procédures, notamment en droit public. Il permet aussi d'élever le niveau et la cohérence des règles garantissant l'impartialité devant les juridictions ordinaires, engageant parfois la modification de textes.
