THE AIM OF THIS THESIS IS TO ENSHRINE THE EXISTENCE OF AN OBLIGATION WHICH HAS ITS ORIGIN IN DOCTRINE AND JURISPRUDENCE, ACCEPTANCE OF WHICH VARIES. THE FIRST PART IS DEVOTED TO THE GENESIS OF THE DUTY OF LOYALTY, CONTRASTING CLASSIC ACCEPTANCE PROHIBITING THE EMPLOYEE FROM DOING HARM AND COMMITING HIM TO CARRY OUT HIS FUNCTIONS IN GOOD FAITH, WITH A MORE PROBLEMATIC ACCEPTANCE, DESCRIBED AS COOPERATION, LEADING TO RESTRICTION ON THE FREEDOMS OF THE EMPLOYEE. AN THE QUEST FOR COLLABORATION IS SET IN A BILATERAL PERSPECTIVE, THE SECOND PART IS DEVOTED TO THE STUDY OF THE COUNTERPART THE EMPLOYER PROVIDES IN RETURN FOR LOYALTY. SOME OF THEM, with ORIGINS IN JURISPRUDENCE OR THE LAW, EXPRESS THE NEED FOR INTERACTIVE LOYALTY WITHIN THE FIRM.

Abstract FR:

Le but de cette these est de consacrer l'existence d'une obligation d'origine doctrinale et jurisprudentielle dont l'acception varie. La premiere partie est consacree a la genese de l'obligation de fidelite, confrontation entre l'acception classique interdisant au salarie de nuire et l'engageant a executer ses prestations de bonne foi, et d'une acception plus problematique dite de cooperation limitant la liberte du salarie. La recherche de la collaboration s'inscrivant dans une perspective bilaterale, la seconde partie est consacree a l'etude des contreparties patronales dont certaines consacrent l'emergence du concept de fidelite interactive dans l'entreprise.
