Abstract EN:

The ec antidumping law constitutes a principal instrument of the commercial defense within the scope of the common commercial policy (ccp) under the termes of article 113 of the treaty of maastricht. Having recourse to antidumping measures, the european community attempts to protect the community industries from disloyal commercial practices carried out by the enterprises of third countries. To this end, this thesis aims to analyze the juridical system of the ec new antidumping law (the ec regulation n0 384/96) revised after the uruguay round. The preliminary chapter concerns the international notion of dumping defined by the gatt and its intergration in the community juridical order. The first part analyzes the general procedures of the ec antidumping law vis-a-vis third countries. The second part studies the necessary conditions for the institution of antidumping measures. Indeed, the institution of these antidumping measures requires the sine qua non condition that the practices which are subjected to dumping cause injury to the community industry.

La reglementation communautaire de la lutte contre le dumping constitue l'une des principaux instruments de defense commerciale dans le cadre de la politique commerciale commune (pcc) aux termes de l'article 113 du traite de maastricht. Ayant recours aux mesures antidumping, la communaute europeenne tente donc de proteger les industries communautaires face aux pratiques commerciales deloyales effectuees par les entreprises des pays tiers. A cette fin, cette these vise a analyser le systeme juridique de la nouvelle reglementation antidumping communautaire (reglement ce n0 384/96) revisee apres l'uruguay round. Le chapitre preliminaire concerne la notion internationale de dumping telle que definie par le gatt et son integration dans l'ordre juridique communautaire. La premiere partie analyse la procedure generale du droit antidumping communautaire vis-a-vis des pays tiers. La deuxieme partie etudie les conditions necessaires a l'instauration des mesures antidumping. Car l'institution des mesures antidumping necessitent la condition sine qua non que les pratiques faisant l'objet d'un dumping aient entraine un prejudice a l'industrie communautaire.
