The first additional protocol of the european convention on human rights protects the right of property, the only economical right included in the convention at the study of this disposition, the difference between the words employded by the article (of protoco) and the interpretation of it by the european jurisprudence appears. Thie one had extended the sphere of application of this article, by a protection of patrimonial rights in general and by an invention of several rules to control the different interferences to the right of property. The protection is not only contained in article (of protoco), but also in other dispositions of the european convention not dealing with this right. Further more, the possibility of according a fair satisfaction authorize an effective repairing of violations of the right of property. Defective, but constantly moving, the european protection of property is in final real.

Le premier protocole additionnel à la convention européenne des droits de l'homme garantit le droit au respect des biens, seul droit de nature économique énoncé par la convention. L'étude de la disposition protocolaire met en évidence la dichotomie existant entre les termes contenus à cette disposition et l'interprétation qui en est faite par la jurisprudence européenne. Celle-ci a procédé à une extension du champ d'application de l'article 1 du protocole 1 en garantissant les droits patrimoniaux en général et en élaborant un contrôle de légalité, de finalité et de proportionnalité différencié selon le type d'atteinte portée a la propriété. La protection du droit de propriété n'est cependant pas toute entière contenue dans cet article car le recours à d'autres dispositions de la convention permet un renforcement des garanties offertes au propriétaire. De plus, l'octroi d'une satisfaction équitable autorise une réparation effective des violations du droit de propriété. Imparfaite, mais néanmoins en constante évolution, la protection conventionnelle de la propriété n'en est alors pas moins réelle.
