This study aims at giving an account not only of the whole of the judicial rules of the conciliation boards'procedure but also of the influence on the proceedings of the behaviours of the judges sitting on the said conciliation boards. The situation and its reality being seen from the angle of the conflicts of roles and procedures which can be observed within this jurisdiction : - conflicts of roles between non-professional judges of quite different, if not totally opposite sociological quarters ; - conflicts of procedures between the rules of the code of labour which aim at trying to protect the wage-earner against the employer who holds the economical power and the rules of the code of civil law, of civilist inspiration more akin to property law. The applicable rules and the judges' behaviour are studied through the progress of the proceedings of a case. A large part of this study is also devoted to the way the judges from both parties lake their decisions during their private sitting. The rules concerning the law of the proof and the measures of investigation based on the central theme constituted by the appreciation by the conciliation board of the genuine and serius reason of the discharge will also be described. This study has been conducted by a conciliation board's judge. It allows us to have a clear and sound knowledge of the whole of the applicable texts on the one hand and on the other hand of the judicial reality such as it can be experienced from the very heart of the concerned jurisdiction.

Cette these a pour objet de rendre compte de l'ensemble des regles juridiques de la procedure prud'homale mais egalement de l'influence des comportements des juges prud'hommes sur le proces. La realite prud'homale est etudiee sous l'angle des conflits de roles et de procederes que l'on peut observer dans cette juridiction; conflits de roles entre des juges non professionnels issus de milieux sociologiques tout a fait differents et souvent en totale opposition. Conflits de procedures entre les regles du code du travail qui visent a assurer la protection du salarie par rapport a l'employeur qui detient le pouvoir economique et les regles du code de procedure civile, d'inspiration civiliste, plus proches du droit de propriete. Les regles applicables et les comportements sont etudies a travers le deroulement du proces prud'homal. Une large partie de cette etude est egalement consacree a la facon dont les juges paritaires prennent leur decision lors du delibere. Sont ainsi decrites les regles relatives au droit de la preuve et aux mesures d'instruction a partir du theme central que constitue l'appreciation de la cause reelle et serieuse du licenciement par la juridiction prud'homale. Cette etude, realisee par un conseiller prud'homme, permet a la fois d'avoir une bonne connaissance de l'ensemble des textes applicables mais egalement de la realite judiciaire telle qu'elle peut etre vecue a l'interieur meme de la juridiction.
