La protection des brevets dans l’accord de libre échange entre le Maroc et les États-Unis d’Amérique

This thesis attempts to describe the effects of the agreement of free exchange concluded recently between Morocco and the United States on the protection of intellectual property rights. The object of our analysis concerns the recent commitments taken by both countries in protection of patents. At first, the alignment of Morocco on the standards of the WTO (WORLD TRADE ORGANIZATION) with the succession of the law 17-97 and the transposition of the capacities of the agreement of free exchange in 2005 concerning in particular the field of application of rules relative to the protection of patents. Then, we brought to light the comparison between the commitments taken by both countries in harmonization of the rights of protection of the patents of invention and fight against the anticompetitive practices concerning the rights conferred by the patent. Finally this search demonstrates the bilateral protection spread to certain inventions which present a considerable general interest to satisfy.

Cette thèse s’attache à décrire les effets de l’accord de libre échange conclu récemment entre le Maroc et les États-Unis sur la protection des droits de propriété intellectuelle. L’objet de notre analyse porte sur les récents engagements pris par les deux pays en matière de protection des brevets d’inventions. D’abord, l’alignement du Maroc sur les standards de l’OMC avec l’avènement de la loi 17-97 et la transposition des dispositions de l’accord de libre échange en 2005 concernant notamment le champ d’application de règles relatives à la protection des brevets. Ensuite, nous avons mis en évidence la comparaison entre les engagements pris par les deux pays en matière d’harmonisation des droits de protection des brevets d’invention et de lutte contre les pratiques anticoncurrentielles portant sur les droits conférés par le brevet. Enfin cette recherche démontre la protection bilatérale étendue à certaines inventions qui présentent un intérêt général considérable pour satisfaire certaines exigences liées à l’accès de la population à certains produits protégés par les brevets.
