The foreign private investments play an important role in the congo's development strategy. To obtain this objective, a series of judicial mechanisms has been elaborated and the investment code is the principal component of this strategy which has been completed by specific rules concerning two principal sectors of the economy : oil and wood. This legal frame is the toundation of the relationship which is being established between congo and transnational corporations. But before the importance of stakes and complexity of the operation, these relations have been oriented rather toward the research of mutual guaranties.

Les investissements prives etrangers jouent un role important dans la strategie de developpement au congo. A cet effet, le congo a elabore des mecanismes juridiques pour la realisation de cette politique. Le code des investissements en constitue le dispositif principal. Celui-ci est renforce par des dispositions specifiques concernant deux secteurs particuliers : le petrole et le bois. Le cadre juridique ainsi elabore sert de base aux rapports qui s'etablissent entre le congo et les societes transnationales. Mais devant l'importance des enjeux et la complexite des operations, les rapports entre le congo et les societes transnationales se sont orientes davantage vers la recherche de garanties reciproques.
