Legitimacy consists of the capacity of the system to engender and maintain the belief that the existing political institutions are the most appropriate for society. The legitimate family used to be defined by the institution of marriage. According to the doctrine of the European Court of Human Rights, the notion of family under this provision is not confined to marriage-based relationships and may encompass other de facto family ties where the parties are living together out of wedlock. A child born out of such a relationship is ipso jure part of that family unit from the moment and by the very fact of his birth. The Act n°2001-1035 of the 3rd December 2001 confirms the emancipation of the rights of the isuue of the instate those of the couple from the normative monopoly of marriage. Legitimacy no longer being a reference point any more in current Family Law has allowed neutrality, towards the various types of couple to become the essence of legality

La légitimité, qui renvoie à la justification du droit de gouverner, incarnait en droit de la famille le caractère institutionnel du mariage. La loi n°72-3 du 3 janvier 1972 prenait en compte la prééminence du mariage tout en posant des bases solides pour la future égalité des filiations, faisant preuve d'un subtil équilibre entre les droits du mariage et les droits des enfants nés en dehors de celui-ci. La loi n°2001-1135 du 3 décembre a entériné au niveau successoral et au niveau du couple ce qui était déjà valable à propos des enfants hors mariage : la consécration de l ‘individualisme comme variable des vocations ab intestat. Dans cet esprit, l'ordonnance n°2005-759 du 4 juillet 2005 reflète au niveau de la filiation la montée en force de la matrimonialité. La " diabolisation " de la légitimité en tant que référence normative contraignante semble avoir conduit le législateur au culte de la neutralité comme élément directeur de la légalité
