Town planning and transport are intimately linked. In spite of this, town planning legislation has ignored for a long time the reciprocity of their crossed influences. Faced with the growth of traffic, the city has become the territory of motor vehicles, thus leading to an increase in pollution and to urban sprawl. The realisation of the interdependence between town planning and transport has progessively emerged. The SRU law of December 13th, 2000, gives a legal framework to this relationship and makes transport one of the pillars of rejuvenated town planning legislation. This synergy, rediscovered through law, rests on the concept of sustainable development and plays a part in integrated environmental protection. From now on, coherence between town planning and transport has to be maintained whilst insuring the strictness and security provided by the legal regulations. This study aims to translate this relationship in the field of the law. It analyses how the tools of town planning laws integrate the concerns linked to transport and their juridical consequences, especially in the light of the new understanding of town planning legislation brought by the SRU law.

L'urbanisme et le transport sont intimement liés, pourtant le droit de l'urbanisme a longtemps ignoré leurs influences réciproques. Face à la croissance des déplacements, la ville est devenue le territoire de l'automobile conduisant ainsi à l'augmentation des pollutions et à l'étalement urbain. Une prise de conscience de l'interdépendance de l'urbanisme et du transport a progressivement émergée. La loi solidarité et renouvellement urbains du 13 décembre 2000 consacre juridiquement cette relation et fait du transport l'un des piliers du droit de l'urbanisme renouvelé. Cette synergie redécouverte par le droit s'appuie en partie sur le concept de développement durable et participe incontestablement à une protection intégrée de l'environnement. L'enjeu est d'assurer la cohérence entre l'urbanisme et le transport tout en garantissant la rigueur et la sécurité de la règle de droit. Cette étude cherche à traduire cette interdépendance sur le terrain du droit. Il s'agit d'analyser comment les objectifs et instruments du droit de l'urbanisme intègrent les préoccupations liées au transport et, les conséquences juridiques de cette prise en compte dans le cadre de la nouvelle conception du droit de l'urbanisme portée par la loi SRU. En définitive, on s'aperçoit que le transport, volens nolens, renouvelle la matière du droit de l'urbanisme.
