La présente recherche se propose d'identifier les éléments de réponse à une répression cohérente et efficace en matière de fraude au détriment du budget communautaire. La sanction d'un délit souvent transnational s'inscrit dans un cadre supranational atypique où les espaces normatifs nationaux ont un rôle essentiel. Une politique criminelle adéquate doit dépasser le cadre conventionnel classique afin d'élaborer un modèle répressif qui ne peut faire l'économie ni d'un droit pénal substantiel ni d'un droit processuel supranational pourtant naissant. Cependant la répression de la fraude au détriment du budget communautaire ne peut ignorer la crise de légitimité de l'Union européenne à laquelle il faudra pourtant remédier afin de créer un véritable espace public européen.

The research hereby aims at identifying the elements of answer to a coherent and efficient repression to the fraud to the detriment of the EC budget. The sanction of an offence often transnational is part of an atypical supranational frame in which the national normative areas have an essential part. An appropriate criminal policy has to go beyond the standard conventional frame in order to elaborate a repressive pattern that cannot do without nor a substantial criminal law neither a supranational process law yet incipient. However, the repression of the fraud to the detriment of the EC budget cannot ignore the legitimacy crisis of the European Union, which will have to be remedied nevertheless in order to create a real European public area.
