The quat and the manner in which the courts treat the expulsion demands illustrates the difficult conciliation of property rights, principle constitutional value and right to decent lodging, objective to constitutional value. The suqatter is an occupant without rights or any legal claim. His expulsion is frequently pronounced, and creates the problem of his rehousing by the authorities. The claim of the right to lodging is then confronted directly to the property rights. If property rights and the right to lodging are compared, it evokes the opposition between the liberty rights and the credit rights. If the property right protects itself, the right to lodging claims itself. The thesis studies the evolutions suffered by the property rights, by the right to lodging and their difficult conciliation, by the expulsion procedure centred on the reports between these rights and the right incidences of the squat phenomenon

Le squat, et la manière dont les tribunaux traitent les demandes d'expulsion illustrent la difficile conciliation du droit de propriété, principe de valeur constitutionnelle et du droit au logement décent, objectif à valeur constitutionnelle. Le squatter est un occupant sans droit ni titre. Son expulsion est fréquemment prononcée, sa mise en oeuvre pose le problème du relogement par les pouvoirs publics. La revendication du droit au logement se trouve alors confrontée directement au droit de propriété. Mettre en parallèle le droit de propriété et le droit au logement évoque l'opposition entre les droits-libertés et les droits-créances. Si le droit de propriété se protège, le droit au logement se revendique. La thèse étudie les évolutions subies par le droit de propriété, par le droit au logement et leur difficile conciliation, par la procédure d'expulsion centrée autour des rapports entre ces droits et les incidences en droit du phénomène du squat
