Protecting children has been one of the objectives of Madagascar government ever since the independence of the country. Ordinance 62-038 has laid down the basic principles of this project. Assessing it now, that is, more than fifty years after the establishment of this ordinance, has become an urgency. The aim of this research paper is, first of all, to approach and evaluate all the aspects of this protection and secondly, to put forward some reforms tracks. Beforehand, the paper aims at explaining the status of children in the Malagasy society and mentality starting from the early days of traditional society until the present day. In our point of view, influences of those consideration are very important for the child protection nowadays.

La protection de l'enfance est une des ambitions du gouvernement malgache depuis l'indépendance. L'Ordonnance 62-038 pose les principes généraux qui l'entourent. En ce début de troisième millénaire, un bilan est plus que nécessaire. Dans cet objectif, notre recherche aborde et évalue toutes les facettes de cette protection dans un premier temps. Elle tente, dans un deuxième temps, de proposer des pistes de réformes. Mais au préalable, elle essaye de retracer la considération de l'enfant dans la société et dans la mentalité malgache depuis l'époque traditionnelle à nos jours. L'influence de cette considération sur la protection de l'enfance nous semble non négligeable.
