The legal status of the software is not satisfactory in terms of criticism from the doctrine. Indeed, this work shows that the classical theory is in perfect mismatch with legal practice and it creates perverse effects harmful to the economy of the software. The cause of the error resulting from pathological legal description of the thing software built by the classical theory whose fundamental paradigms are the immateriality and a monolithic perception of the software. Thus, through a dual qualification and materialistic concept of the software, a new reading of the law best suited to the objective reality of the concept of software is possible. The thesis goes beyond the recurring debate on the patent and prospective software to offer a positive solution-oriented and requires no legislative change. Accordingly, the materialist theory is an alternative preferred to the classical theory.

Le statut juridique du logiciel n’apparaît pas satisfaisant au regard des nombreuses critiques issues de la doctrine. En effet, ces travaux démontrent que la théorie classique est en parfaite inadéquation avec la pratique juridique et qu’elle engendre des effets pervers néfastes à l’économie du logiciel. La cause résulte de l’erreur pathologique de qualification juridique de la chose logicielle bâtie par la théorie classique dont les paradigmes fondamentaux sont l’immatérialité et une perception monolithique du logiciel. Ainsi, par le truchement d’une qualification dualiste et matérialiste de la notion de logiciel, une nouvelle lecture du droit objectif mieux adaptée à la réalité de la notion de logiciel est possible. La thèse dépasse le débat récurrent et prospectif relatif au brevet de logiciel pour proposer une solution à vocation positive qui ne nécessite aucun changement législatif. Partant, la théorie matérialiste constitue une alternative préférentielle à la théorie classique.
