The principle of legality is an universal principle. It's so strong that admitted everywhere in the world. This principle is no more what it was, there has been an evolution. The source of crime is not exclusively the law in the strict meaning but in the extended meaning which includes the law and the orders. The principle of legality has become smoother, but this doesn't mean that it has become weaker, because the derogations to the principle of legality concerning the strict penal law are very rare. The most of these derogations concern extra penal cases that means out of the penal Code. The jurisprudence has played an extremely important part in favour of respect of the principle of legality not only concerning the penal law but also in extra penal law, which has a repressive finality. Therefore we find all the powers of the state progressively lead to the respect of the principle of legality. Nowadays, the few derogations to this principle doesn't stop it to be the headstone of penal law.

Le droit pénal moderne repose sur des principes philosophiques fondateurs, parmi lesquels le principe légaliste occupe une place centrale. Principe universel, il est admis dans tous les pays du monde. Il n'est plus ce qu' il était : il a évolué. La source de l' infraction n' est plus exclusivement la loi au sens strict, mais au sens large, qui englobe la loi et le règlement. L' assouplissement du principe dans le droit pénal des affaires ne constitue pas une atténuation au principe, parce que les dérogations à ce principe, en droit pénal proprement dit, sont très rares. La plupart des assouplissements tombent en matière extra-pénale à savoir hors le Code pénal. La jurisprudence a joué un rôle très important en faveur du respect du principe légaliste. Ainsi tous les pouvoirs de l' État avancent vers le respect du principe légaliste. Actuellement, les quelques entorses à ce principe n' empêchent pas celui-ci d' être la pierre angulaire du droit pénal.
