Abstract EN:

The right to health is a human and constitutional right. The notion of fundamental rights enables it to be elevated to the status of a legal right because of its aim, which is to protect and restore the health of all human beings. This aim of the right to health, which determines its content, is above all the indispensable reference point for its effective implementation. In particular, it involves the rejection of any analysis of positive law leading to renunciation of its benefit to human beings on the grounds that they are not subjects of law. The right to health benefits every human being, so even the unborn child should be subject of law in order to be able to benefit from it. Moreover, this right calls into question any jurisprudence contrary to its aim. It is thus in conflict with the recognition of a right not to be born in bad health and the refusal to grant penal protection to the unborn child who is victim of involuntary manslaughter.

Abstract FR:

Le droit à la santé est un droit de l'homme et un droit subjectif de valeur constitutionnelle. La notion de droit fondamental permet même de l'ériger en droit matriciel en raison de sa finalité qui est de protéger et de rétablir la santé de tout être humain. Cette finalité du droit à la santé, qui permet d'en déterminer le contenu, constitue surtout le point de référence incontournable de sa mise en œuvre effective. Elle impose notamment de rejeter toute analyse du droit positif aboutissant à renier son bénéfice à des êtres humains au motif qu'ils ne sont pas sujets de droit. Le droit à la santé bénéficie à tout être humain si bien que même l'enfant à naître doit être sujet de droit pour pouvoir en bénéficier. Ce droit permet par ailleurs de remettre en cause toute jurisprudence contraire à sa finalité. Ainsi s'oppose-t-il à la reconnaissance d'un droit de ne pas naître en mauvaise santé et au refus d'accorder la protection pénale à l'enfant à naître victime d'un homicide involontaire.
