Abstract EN:

This PhD dissertation deals with the compensation awarded to victims contaminated by HIV through transfusion or injection of blood products in France. This is not a "classic" case of wrongful injury, because the damage is related to the prospect of their own death. The disease is progressive, sequential and probably fatal, so that the determination of compensation requires the use of a theoretical dynamic model of health. Our work is based on the data files of the national compensation fund. The empirical results are consistent with the theoretical model.

Cette thèse traite de l'indemnisation des victimes contaminées par le VIH par transfusion ou injection de produits sanguins en France. Il ne s'agit pas d'un cas " classique " de Wrongful Injury, dans la mesure où leur préjudice concerne la perspective de leur propre mort. Compte tenu du caractère évolutif, séquentiel et probablement fatal de la maladie, la détermination d'une compensation est appréhendée à l'aide d'un modèle inter-temporel dépendant de l'état de santé. L'observation empirique de l'indemnisation accordée par le Fonds d'Indemnisation des transfusés et Hémophiles (FITH) est en cohérence avec ce que notre modèle a permis de prévoir.
