La définition de la propriété sur le génome humain : connaissance scientifique, patrimoine génétique humain, et incertitude radicale

The aim of the thesis is to define an optimal structure of property rights on the human genome. It concerns the following topics: i) the definition of an optimal institutional structure for the production of knowledge about the human genome; ii) the definition of a management criterion for the human genetic pool. The analysis integrates the radical uncertainty, which is inherent to both the production of scientific knowledge and the biological evolution of species. The results are twofold. Firstly, it is strictly impossible to discriminate between different systems of knowledge production. Secondly, it can be in the interest of parents to choose children that are genetically different one from the other.

La thèse a pour objet la définition d'une structure optimale de droits de propriété sur le génome humain, et porte ainsi sur : i) la définition d'une structure institutionnelle optimale encadrant la production de connaissances sur le génome ; ii) la définition d'un critère de gestion du patrimoine génétique humain. Notre analyse intègre l'incertitude radicale inhérente à la production de connaissances scientifiques et à l'évolution biologique des espèces. Nos recherches permettent de conclure à l'impossibilité de discriminer entre différents systèmes de production de connaissances, et de démontrer que les parents peuvent avoir intérêt à choisir des enfants génétiquement différents les uns des autres.
