Abstract EN:
If a person has cause to doubt the validity, in the eyes of the roman catholic church, of the marriage contract into which he or she has entered, it is possible to refer the matter to an official marriage tribunal; the latter is endowed with the authority to pronounce the marriage null and void, should this prove to be the case. This dissertation presents the results of an enpirical study conducted among 20 persons whose cases were pronounced on heard by the ecclesiastical tribunal of the diocese of rottenburgstuttgart. These laypersons were questioned on how they perceived five technical expressions frequently used in tribunal hearing. These expressions were as follows: the mullity of a marriage, the matrimonial hearing, the marriage tribunal, the petition, and the witness. The author adopts a wide definition of "perception" encompassing all the effects language has on an individual (cognitive and emotional reactions and behavioral patterns) and including the operant psychological and sociological factors (age, profession, copnfession, experience). Not only do these factors constrain him in concrete communicative situations, but they can also affect the way he @perceives particular expressions. This study is based on the contents of 20 recordel and transcribed interviews. Analysis of these empirical case histories shows that, apart from particular perceptions specific to the individaul in question, a certain number of shared perceptions do exist of several terms and of several persons. Also commented or are the perceptions associated with tribunals of civil society, likewise what it feels like to be accused and to have to defend oneself (and to be uncertain e. G. As to the outcome).
Abstract FR:
