Félicité publique et droits de l'individu dans l'utilitarisme de Jeremy Bentham

It is argued that Bentham's utilitarianism conciliates the promotion of the greatest happiness of the greatest number with the protection of individual rights and personal security. His psychology does not attribute any specific meaning to happiness but only defines the conditions to human well-being. Bentham's deontology is a normative ethical system which lays stress on responsibility and rationality. It allows egoism whenever it is not socially harmful. Legislation should aim at promoting every man's interest, so that rights are deduced from utility. Although he rejects the language of human rights, Bentham's pragmatic arguments tend to promote them. When he interferes with the citizens the legislator should avoid provoking pain and should apply punishment only when there is no other solution. Bentham pleads in favour of a representative regime and relies on the governed to keep watch on the rulers, and thus guarantee the security of the governed within a transparent democracy.

L'utilitarisme de Bentham concilie la promotion du plus grand bonheur du plus grand nombre avec la protection des droits individuels et la sécurité des personnes. Sa psychologie n'assigne pas un contenu précis au bonheur mais définit simplement les conditions de la poursuite de l'intérêt individuel. La déontologie est une éthique de la responsabilité à caractère normatif, qui enseigne la recherche de l'intérêt bien compris et autorise l'égoi͏̈sme quand il n'est pas nuisible socialement. La législation doit viser la promotion de tous les intérêts : les droits sont déduits de l'utilité et bien qu'il récuse toute référence aux droits de l'homme, Bentham les fonde par une argumentation pragmatique. La pratique législative et judiciaire doit économiser la douleur et ne sanctionner qu'en dernier recours. Partisan d'un régime représentatif, Bentham compte sur la surveillance des gouvernants par les gouvernés pour garantir la sécurité de tous dans le cadre d'une démocratie transparente.
