When bringing out of oblivion a new source concerning marocan history, we wished to cast an additional lignt on historical studies dealing with the mediterranean basin. The object of our study is a legal text entitled "the councils of the muslim judges" and written by Al-Yafrani at the beginning of the 16th centuries. Our thesis is centered on the critical edition, the translation and the commentary of this work. When presenting Al-Yafrani's text, we wished to establish a dialogue between the historian and his source. The historical commentary in the first volume is set to be an introduction of the source in its different contexts. According to us, the study of the container and the contents enables us to better read this kind of work. In defining an appropriate methodology for the exploitation of a legal source, we managed to establish some historical themes. In defining the social groups wich appear in Al-Yafrani's text, we made an attempt to show an historical vision of a legal source.

En exhumant de l'oubli une source nouvelle de l'histoire du Maroc, nous avons voulu apporter un éclairage supplémentaire aux études historiques ayant trait au bassin méditerranéen. L'objet de notre étude est un texte juridique rédigé par Abu Abd Allah Sidi Muhammad Ibn Abd Allah Ibn Muhammad Al-Yafrani au début du XVI/Xème siècle et intitulé : les séances des cadis et des Hakim (Magalis Al-Qudat Wa-L-Hukkam) notre thèse est centrée sur l’édition critique, la traduction et le commentaire de cet ouvrage. Dans la présentation du texte d'Al-Yafrani, nous avons souhaité établir un dialogue entre l'historien et sa source. Le commentaire historique qui figure dans le premier volume se veut une présentation de la source dans ses différents contextes. Selon nous, l'étude du contenu et du contenant permettent une meilleure lisibilité de l'œuvre. En définissant une méthodologie idoine a l'exploitation d'une source juridique, nous avons pu établir certains thèmes historiques. En définissant les groupes sociaux qui apparaissent dans le cours du récit d'Al-Yafrani, nous avons tenté de proposer une vision historique d'une source juridique.
