Les constructions historiques d'un objet juridique : les favelas de Rio de Janeiro de la fin du XIXe siècle à nos jours

This work is designed to establish the historical reconstruction during quite a long period -from the end of the XIX century to the present time - of the somewhat cumulative and controversial process of development and consolidation of the Rio de Janeiro favelas (slums) as a specific juridical category. Such initiative is not limited to juridical issues, but extends to how the aforementioned reconstruction refers to a second sociopolitical look at law. The construction of the juridical object favela gradually turned out to be a juridical variable in itself that, while coming along on top of the juridical issues concerning the favelas, brought about a simplifying standardization of their juridical representation, in spite of the special features inherent to the multiple juridical statutes on land prevailing among the favelas, sometimes within one same favela. Therefore, this work is intended to bring out, on one side, the sociopolitical issues that are part of the very process of constructing this juridical object, and on the other side, the social effects resulting from this nominative function of the law, especially in respect of the various practices and strategies of a range of players, aimed at seizing the urban space in order to guarantee a privileged access to a dynamism peculiar to the cities.

Ce travail vise à reconstituer historiquement dans une période relativement longue - depuis la fin du 19e siècle jusqu'à nos jours - le processus, plus ou moins cumulatif et conflictuel d'élaboration et de consolidation des favelas de Rio de Janeiro en tant que catégorie juridique spécifique. Cette démarche ne s'intéresse pas seulement aux strictes questions juridiques, mais à la façon dont cette reconstitution renvoie à une relecture sociopolitique du droit. La construction de la favela en tant qu'objet juridique s'est avérée constituer progressivement une variable juridique en soi qui, tout en se greffant aux faisceaux des questions juridiques concernant les favelas, a entraîné une uniformisation simplificatrice de la représentation juridique de celles-ci, et ceci en dépit des particularités inhérentes à la multiplicité des statuts juridiques fonciers existants entre les favelas, voire à l'intérieur d'une même favela. Ce travail envisage ainsi de dégager, d'une part, les enjeux sociopolitiques inhérents au propre processus de construction de cet objet juridique, et, de l'autre, les répercussions sociales entraînées par cette fonction nominative du droit notamment en ce qui concerne les diverses pratiques et stratégies des différents acteurs visant à s'approprier l'espace urbain en vue de s'assurer un accès privilégié au dynamisme propre de la ville.
